The online store uses the Shopify platform to manage the website, product catalogue and e-commerce operations.
These terms and conditions govern access to the website and the sale of products offered through the Rocche della Sala online store.
2. Scope
By submitting an order through the website, you agree to these terms and conditions of sale.
Consumers are in all cases entitled to the mandatory protections provided by Italian Legislative Decree No. 206/2005 – the Italian Consumer Code – and by applicable Italian and European Union legislation.
For the purposes of these terms, a “consumer” means a natural person who purchases products for purposes unrelated to their business, commercial, craft or professional activity.
3. Purchase of alcoholic beverages
The sale of alcoholic beverages is reserved exclusively for persons aged 18 or over.
By placing an order containing wine or other alcoholic beverages, the purchaser declares that they are of legal age.
Rocche della Sala carries out the checks necessary to comply with legislation concerning the sale of alcoholic beverages to minors and may request appropriate documentation proving the purchaser's age.
If the purchaser's legal age cannot be verified, Rocche della Sala reserves the right to refuse or cancel the order, with a refund of any amounts already paid.
4. Products
Rocche della Sala mainly sells agricultural and food products, including extra virgin olive oil and wine.
The essential characteristics of each product are described on the relevant product pages of the online store.
Product images are for illustrative purposes. Minor differences, for example in colour shades, vintage, packaging or other non-essential elements, may result from product updates or the display settings of the device used.
Any such differences do not affect the essential characteristics or quality of the product purchased.
5. Prices
All prices intended for consumers are expressed in euros and include VAT and other applicable taxes, unless otherwise required by law.
Any shipping charges or other additional costs are shown to the customer before the order is completed and, in all cases, during checkout.
The applicable price is the price displayed at the time the order is submitted.
Any promotions, discount codes or special offers are valid under the conditions and for the period stated on the website.
6. Orders and conclusion of the contract
The customer selects the desired products, adds them to the cart and completes the purchase process by providing the requested information.
Before submitting the order, the customer has the opportunity to review the selected products, quantities, total price, any shipping costs and the information provided.
After the order has been submitted, a confirmation will be sent to the email address provided by the customer.
Rocche della Sala may refuse or cancel an order in the event of product unavailability, an obvious error in the price or description, inability to verify the information provided by the customer, suspected fraudulent use of the payment system or another legitimate reason.
If an order that has already been paid for cannot be accepted or fulfilled, the amounts paid will be refunded.
7. Payments
Payment can be made using the payment methods made available during checkout.
Payment transactions may be processed by Shopify or by third-party payment service providers.
Rocche della Sala does not directly store the full payment card details used by the customer where such information is processed by the relevant payment service provider.
8. Product availability
Products are offered subject to availability.
If a product becomes unavailable after the order has been submitted, the customer will be informed promptly and will be entitled to a refund of any amount already paid for the unavailable product.
9. Shipping and delivery
Orders are delivered to the address provided by the customer during the purchase process.
Any preparation and delivery times indicated on the website are normally estimates, unless a binding delivery deadline is expressly stated.
In relations with consumers, delivery will in any event take place within the period required by applicable law and, unless otherwise agreed, no later than 30 days after conclusion of the contract.
Rocche della Sala shall not be liable for delays caused by force majeure or other events that are not reasonably within its control, without prejudice to the protections provided by consumer law.
The risk of loss of or damage to the products passes to the consumer only when the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods, except in the cases expressly provided for by law.
Upon delivery, the customer is advised to check the integrity of the parcel and promptly report any damage, breakage or missing products.
10. Right of withdrawal
A consumer purchasing online has the right, subject to the exceptions provided by law, to withdraw from the contract without giving any reason within 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods.
Where several products are ordered in a single order but delivered separately, the withdrawal period begins on the day on which the last product is delivered.
The consumer may communicate the decision to withdraw by sending an explicit statement to Rocche della Sala or by using the electronic withdrawal function available on the online store.
The electronic function is clearly identified by the wording “Withdraw from the contract here”, or equivalent wording, and is available during the period in which the right of withdrawal may be exercised.
Following electronic submission of the withdrawal request, the consumer will receive an acknowledgement of receipt on a durable medium without undue delay.
The products must be returned without undue delay and, in any event, within 14 days from the communication of withdrawal.
Unless otherwise indicated by Rocche della Sala, the direct cost of returning the products is borne by the consumer.
The consumer is responsible only for any reduction in the value of the products resulting from handling other than what is necessary to establish their nature, characteristics and conformity.
11. Exceptions to the right of withdrawal
The right of withdrawal does not apply in the cases provided for by Article 59 of the Italian Consumer Code.
These may include, where the relevant legal conditions are met, products liable to deteriorate or expire rapidly, products made to order or clearly personalised, and sealed goods which, after being unsealed by the consumer, are not suitable for return for reasons of health protection or hygiene.
Any exclusion of the right of withdrawal applicable to a specific product will be clearly stated before purchase.
12. Refunds
Where the right of withdrawal has been validly exercised, Rocche della Sala will refund the payments received from the consumer, including any standard delivery costs paid, within 14 days from the date on which it is informed of the decision to withdraw.
Any additional costs resulting from the customer's choice of a delivery method that is more expensive than the standard delivery method offered will not be refunded.
The refund may be withheld until the returned products have been received or until the consumer has provided evidence that they have been sent back, whichever occurs first.
Unless otherwise agreed, the refund will be made using the same payment method used for the original purchase.

13. Damaged, incorrect or non-conforming products
The customer is advised to inspect the products upon delivery.
In the event of a product being damaged during transport, incorrect, missing or not corresponding to the order, the customer may contact Rocche della Sala at info@rocchedellasala.it, preferably attaching photographs that may assist in assessing the issue.
All rights granted to consumers under the statutory guarantee of conformity provided by the Italian Consumer Code remain fully applicable, taking into account the nature and characteristics of the products purchased.
These terms and conditions do not in any way limit the mandatory rights granted to consumers by law.
14. Errors and inaccuracies
Rocche della Sala takes the utmost care to ensure that the information published on the website is accurate.
If material or obvious errors are identified in descriptions, prices, availability or other information, Rocche della Sala may correct them promptly.
If an error affects an order that has already been placed, the customer will be informed and, where possible, may choose whether to confirm the order under the corrected conditions or cancel it and receive a refund of any amounts already paid.
15. Intellectual property
The content available on the website, including texts, photographs, images, trademarks, logos, videos, graphic elements and other materials, belongs to Rocche della Sala or the respective rights holders and is protected by applicable intellectual property laws.
The reproduction, distribution, modification or commercial use of such content without the prior authorisation of the relevant rights holder is prohibited, except where permitted by law.
16. Third-party services and links
The website may use third-party services or contain links to third-party platforms and websites.
Rocche della Sala is not responsible for the content, contractual terms or privacy policies of external websites that are not directly managed by the company.
17. Shopify
The online store uses the Shopify platform, which provides Rocche della Sala with the technological infrastructure required to operate its e-commerce activities.
However, the contract for the sale of the products is concluded directly between the customer and Rocche della Sala s.s. Agricola.
Shopify is not the seller of the products offered by Rocche della Sala.
18. Privacy
The processing of personal data through the website is governed by the Privacy Policy published on the website.
Certain data may also be processed by Shopify and other service providers used to operate the online store, as described in the Privacy Policy.
19. Liability
Nothing in these terms and conditions may be interpreted as excluding or limiting any mandatory rights granted to consumers under applicable law.
Rocche della Sala shall not be liable for temporary interruptions of the website, malfunctions or delays caused by circumstances not reasonably within its control, without prejudice to any mandatory provisions of applicable law.
20. Applicable law and jurisdiction
These terms and conditions are governed by Italian law.
For customers who qualify as consumers, any rights granted by the mandatory laws of the country in which the consumer resides remain unaffected, where applicable.
For disputes involving a consumer resident or domiciled in Italy, the competent court shall be the court of the consumer's place of residence or domicile where required by law.
The possibility of using alternative dispute resolution procedures available under applicable law remains unaffected.
21. Changes to these terms
Rocche della Sala may update these terms and conditions to reflect changes in legislation, technology or commercial practices.
Any changes will not affect the terms applicable to orders concluded before the changes enter into effect.
The updated version will be published on this page together with the date of the latest update.
